Terms and conditions
You agree that the following are the terms and conditions which, together with the Refund policy and Privacy policy, govern the formation of the contract between you and HSC Study Lab for the use of the Course(s) when HSC Study Lab accepts your enrolment into a Course and payment of the Fee by you is confirmed.

Definitions
HSC Study Lab refers to Access Macquarie Ltd (ACN 003 849 198) t/as HSC Study Lab, a Macquarie University company.
Course means an online HSC preparation Course(s) provided by HSC Study Lab via its website.
Course Materials includes but is not limited to all text, graphics, images, pictures, drawings, video and audio recordings provided online by HSC Study Lab as part of a Course.
Fee refers to the listed price (inclusive of GST) of a Course.

Enrolment
If you are under 18 years of age, you must have the express consent of your parent or guardian, in order to enrol in a Course.
Enrolment is complete when you are issued with a username and password by HSC Study Lab. Access to the Course is granted for a period of 12 months from completion of enrolment.
It is your responsibility to keep your username and password safe and secure.
Enrolment in a Course is personal to you and your username and password must not be shared with any other person other than your parent or guardian.

Payment
You may pay the Fee using a Visa or MasterCard credit or debit card via the payment gateway or by Pay Pal. If the credit or debit card is not issued in your name, you must have the permission of the cardholder to use their card for the Fee.
When your payment is confirmed, the Fee (minus any discounts or credit applied if using a valid discount voucher or credit coupon), will be deducted from your credit or debit card and a tax invoice emailed to your nominated email address.

Intellectual property
Intellectual property in the Course Materials, logos and other material and information available on the HSC Study Lab website, is owned by HSC Study Lab. You may not copy, reproduce, modify or adapt any or all of the Course Materials and other material available on the HSC Study Lab website.

Availability
Courses and Course Materials are provided via the HSC Study Lab website. This website may be temporarily unavailable from time to time due to scheduled maintenance. All efforts will be made to notify you beforehand of scheduled maintenance. In the event that access to the website, Courses and Course Materials becomes unavailable for a prolonged period of time, an extension will be granted in accordance with our Refund policy.

No commercial use
Except as set out below, all Courses are available for non-commercial use only. HSC Study Lab reserves the right to refuse orders from businesses that we consider are for commercial concerns. You may not re-sell or make available to any third party the Courses without the prior written consent of HSC Study Lab.
Subject to paying the applicable fees, universities and other teaching organisations are permitted to deliver the Courses to their named students.

Privacy
Please refer to the Privacy policy for further information on the type of personal information collected by HSC Study Lab and how that information is used, disclosed and stored.

Cancellation and refund
Please refer to the Refund policy for further information on how HSC Study Lab considers requests for cancellation of enrolment and refund of fees.

Notices
You must provide HSC Study Lab with an email address which you use and check regularly. You agree that this will be the address used for all communications with HSC Study Lab and that all notices and other information regarding the Course, HSC Study Lab website and other relevant information will be communicated with you by means of the email address you have provided. You must inform HSC Study Lab as soon as possible of any changes to your email address.

Termination
This contract and your access to the Course will terminate within 12 months of your enrolment into the Course, unless extended by HSC Study Lab as set out in these terms and conditions.
HSC Study Lab may also terminate your access to the Course if, in its reasonable opinion, you breach any of these terms and conditions, and if the breach can be remedied, do not do so within 7 days of receiving notice from HSC Study Lab.

Disclaimers and limitation of liability
HSC Study Lab does not claim, represent or warrant that a Course or Course Materials are suitable for your purposes or are error free. The Courses and Course Materials are intended to be a learning aid only for students in years 11 and 12 in the State of New South Wales and are not intended to be a substitute for student’s own separate study, completion of school work or attendance at school.
All content provided on or through the service, including the information, names, images, pictures, logos and icons regarding or relating to HSC Study Lab, its products and services (or to third party products and services), is provided "as is" and on an "as available" basis. To the extent permitted by law, HSC Study Lab excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. HSC Study Lab does not guarantee the timeliness, completeness or performance of any aspect of the Courses, Course Materials or of website content. While HSC Study Lab endeavours to ensure that all content provided by it is correct at the time of publication no responsibility is accepted by or on behalf of HSC Study Lab for any errors, omissions or inaccurate content on the Course and Course Materials.
HSC Study Lab does not warrant that Courses will be uninterrupted or error free, that defects will be corrected, or that the Courses or website are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
HSC Study Lab discloses that the Course Materials include a number of videos and other animated graphics, some of which may contain flickering images, patterns or flashing lights and that if You suffer from a condition like epilepsy, You should take precautions to satisfy yourself prior to purchasing the Course that viewing those videos and other materials contained within the online Course will not trigger your condition. You should contact HSC Study Lab and your medical advisors to discuss any concerns prior to purchasing the Course.

General
These terms and conditions replaces all previous representations, arrangements, understanding and agreements between you and HSC Study Lab and consists of the entire agreement between you and HSC Study Lab. These terms and conditions are governed by the laws of the State of New South Wales and you and HSC Study Lab each agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
If any of these terms and conditions are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and conditions and the remaining terms and conditions shall survive and continue to be binding and enforceable.
You may not transfer any of your rights under these terms and conditions to any other person. HSC Study Lab may transfer our rights under these terms and conditions to another business or to Macquarie University.
